Published in Global Social Protection, this chapter by ISS PhD researcher Irene Among, Markus Kaltenborn and Natalia Zakhachenko examines the the legal frameworks surrounding social protection systems around the world.

In their chapter, 'The legal framework of institutional change in social protection' the authors argue that national laws influence how social protection systems are structured.
They suggest that legal norms provide stability, and they can provide the impetus for new political developments and institutional changes. However, they can also hinder innovation, as legislative changes often require extensive political negotiations.
They use two case studies – the South African Social Security Agency Act and the South African Khosa case – to illustrate how legal frameworks and court decisions affect the effectiveness and development of social protection programmes, and the role that law can play in shaping complex social policies.
